1. About these terms
These Terms & Conditions ("Terms") govern your use of the Playful Pilots web platform ("Service"), operated by Playful Pilots ("we", "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
2. Who can use the Service
To create a parent account you must be 18 years or older and the parent or legal guardian of the child whose information you are entering, or you must have written consent from the parent or guardian. Therapist accounts must be held by registered allied health practitioners. You are responsible for everything done under your account.
3. Children and supervision
Children do not have their own accounts on the Service in this release. Parents and guardians are solely responsible for supervising any use of the Service that involves a child, including device access, in-app activity, and information shared with therapists.
4. Not a clinical service — no guarantee of outcomes
Playful Pilots is a record-keeping, coordination and communication tool. It is not a clinical service and does not provide diagnosis, treatment, therapy or medical advice. Activities, goals, behaviours, tips and any other content you read on the Service are not medical advice and must not be relied on as such. We make no representation or warranty that use of the Service will improve any clinical, behavioural, developmental or educational outcome.
5. Emergencies
The Service is not for use in emergencies. If you or someone in your care is at risk of harm, in distress, or experiencing a medical or mental-health emergency, call 000 immediately. Other Australian crisis services include Lifeline (13 11 14), Beyond Blue (1300 22 4636), and Kids Helpline (1800 55 1800). Therapists using the Service are similarly required to follow their own profession's escalation and duty-of-care obligations.
6. Therapist responsibilities
Therapists using the Service must hold current professional registration (e.g. AHPRA where applicable), comply with their professional code of conduct, maintain their own clinical records as required by law and their profession, and use the Service only within the scope of their professional practice. The Service may supplement but does not replace any professional record-keeping requirement.
7. Parent / guardian responsibilities
You agree to provide accurate information about your child, to obtain any required consents (including from a second parent/guardian where applicable), to keep your login secure, and to revoke therapist access promptly when no longer needed. You are responsible for any content you upload.
8. Acceptable use
You must not: upload unlawful, defamatory, abusive, fraudulent or infringing content; attempt to access another user's account or data; reverse-engineer, scrape or interfere with the Service; introduce malware; misuse the messaging or notes features; or use the Service to harass any person. We may suspend or terminate accounts that breach this section.
9. Third-party integrations
The Service may use third-party providers (for example for email delivery, hosting, or analytics). Your use of those integrations is also subject to the providers' own terms. We are not responsible for any third-party service.
10. Session documentation
Notes, logs, and other session documentation entered into the Service are records created by parents or therapists for their own purposes. The Service does not validate, edit or audit the clinical content of these records. Therapists remain solely responsible for the accuracy and completeness of any clinical documentation they enter.
11. Data security
We take reasonable steps to secure information stored on the Service (encryption in transit, password hashing, optional two-factor authentication, audit logging). However, no online service can be guaranteed to be 100% secure. You acknowledge this risk when you use the Service.
12. Limitation of liability
To the maximum extent permitted by Australian law, our liability arising out of or in connection with the Service is limited to the fees you paid us in the 12 months before the event giving rise to the claim, or, if you are a parent using a free tier, to AUD $100. We are not liable for indirect, consequential, special or punitive damages, or for loss of profits, revenue, reputation, data or goodwill. Nothing in these Terms excludes any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
13. Changes
We may change these Terms from time to time. We will notify you of material changes by email or in-app notice. Continued use of the Service after a change takes effect means you accept the change.
14. Governing law
These Terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria.
